The news media has been busy with a story about a Maryland father who was “mistakenly” deported to a notorious El Salvador prison. The reality is that although there was a 2019 “do not deport” order from an immigration judge, the deportation was proper and fell in line with the Trump administration’s plan of targeting criminals for deportation. The man, Kilmar Abrego Garcia, is an alleged MS-13 gang member with a criminal background. He was in the country illegally from El Salvador. He has been in the system for quite a while, at least since 2019.

The judge placed the “do not deport” tag on Garcia because there were fears of gang retaliation in El Salvador. Although he never became a citizen, that tag gave him some sort of legal status. He was married to a United States citizen and the child they had together was a US citizen, but he is not.
